Bhubaneswar, Odisha : The 3rd session of Day-2 in the 2nd National Mediation Conference focused on Mediation in State Litigations. Moreover, Hon’ble Shri Justice Aravind Kumar, Judge, Supreme Court of India, chaired the session, and Hon’ble Smt. Justice Sunita Agarwal, Chief Justice, Gujarat High Court, along with Hon’ble Shri Justice Nitin Jamdar, Chief Justice, Kerala High Court, co-chaired it.
Mediation in State Litigation plays a very important role. Therefore, officers should act as state facilitators rather than rule makers. Furthermore, amicably mediated and mutually respected decisions strengthen government mechanisms.
In addition, the session emphasized Strengthening Government Dispute Management Mechanisms, the Role of Mediation in Policy Implementation and Public Interest Matters, Capacity Building for Government Officers and Legal Representatives, and Best Practices and Case Studies of Successful State Mediations. Specifically, it highlighted reducing the burden of state litigation through early settlement of service and employment disputes involving the State, resolving contractual and infrastructure project disputes through mediation, and addressing recurring disputes between citizens and government agencies.
Moreover, other distinguished judges participated, including Hon’ble Shri Justice Ashutosh Kumar, Chief Justice, Gauhati High Court; Hon’ble Shri Justice Arindam Sinha, Judge, Allahabad High Court; Hon’ble Shri Justice C. Harishankar, Judge, High Court of Delhi; Hon’ble Shri Justice Gopinath Puzhankara, Judge, Kerala High Court; Shri Sudarshan Reddy, Advocate General, Telangana; and Shri R. Santhaan Krishnan, Senior Mediator. Additionally, the panelists referred to some remarkable judgements connected with the discussed topics.
